I hereby warrant that I am over 18 and have the right to contract in my own name and that I have read and understand the clauses as detailed below.
PAYMENT & CANCELLATION
• No images will be taken without 100% payment. • No cash will be accepted. • A non-refundable 50% booking fee is required to secure a booking. • Full payment / booking fee is required for mini session less than R 1000 – and is non refundable. • Latecomers will not be allotted additional time on their session – extra time is billed at R450 per 15 minutes.
COPYRIGHT & RELEASE CONDITIONS
I hereby give SAMARENDSE PHOTOGRAPHY the absolute right and permission to use photographic portraits, pictures, digital images or videotapes of myself, or in which I may be included in whole or part, or reproductions thereof for any lawful purpose whatsoever, including but not limited to print or social media, without payment or any other consideration. I hereby waive any right that I may have to inspect and/or approve the finished product or the copy that may be used in connection therewith, wherein my likeness appears, or the use to which it may be applied. SAMARENDSE PHOTOGRAPHY hereby agrees that any images taken are released to the client for personal usage on social media or printing of photographs. Under no circumstances will RAW images be handed over.
EXTRA EDITING
The determination of images delivered is left to the discretion of the photographer. SAMARENDSE PHOTOGRAPHY will do the best editing for your images in their style of previous works. Editing is limited to color correction. Any additional editing required will be billed @ R750 p/h. Examples of additional editing include but are not limited to: Any marks in the face / body that requires extensive touch-up; editing out spots or marks on clothing; slimming and tucking; editing out people or adding people in photographs.
IMAGE DELIVERY TERMS
By booking a photography session with SAMARENDSE PHOTOGRAPHY, you acknowledge and agree to the following delivery timelines: Wedding Photography: A selection of preview (sneak peek) images will be delivered within 48 hours after the wedding date. The full edited wedding gallery will be delivered within 90 days maximum from the wedding date. | All Other Photography Sessions: The full edited gallery will be delivered within 14 days from the date of the session. Delivery timelines may vary slightly during peak wedding season, but every effort will be made to deliver within the stated timeframes.
LIMIT OF LIABILITY
• If for any reason the CLIENT is not entirely satisfied, please communicate with SAMARENDSE PHOTOGRAPHY immediately so the issue can be resolved. Re-shoots will be done at the sole discretion of SAMARENDSE PHOTOGRAPHY and at an extra cost. • The CLIENT understands and agrees that SAMARENDSE PHOTOGRAPHY is not responsible for or liable in any way for any damage to or loss of the CLIENT’s belongings or for any personal injury to the CLIENT before, during or after the session. The CLIENT shall indemnify, defend and hold harmless SAMARENDSE PHOTOGRAPHY and its agents and employees from and against all claims, damages, losses and expenses, including but not limited to attorney fees arising out of or resulting from the performance of the work described in this Agreement.
